Chapter 3: The Survey Nobody Had Read

The date was twenty-eight years old.

Tom stared at it for several minutes.

The survey appeared to show a boundary running through the same area Karen claimed.

But there was something else.

A notation beside the pavement read:

COMMON ACCESS / MAINTENANCE EASEMENT.

Tom photographed the page and sent it to Linda.

Within an hour, the neighborhood group chat was filled with questions.

Frank wanted to know whether it meant he could still park his SUV there.

Linda wanted to know who had left the copy.

Tom didn’t know.

And he wasn’t comfortable assuming.

The following morning, the HOA board held an emergency meeting.

Karen arrived first.

She carried a thick folder beneath one arm.

Tom noticed immediately.

So did everyone else.

Karen placed the folder on the table.

“I told you,” she said. “I have documentation.”

The room became quiet.

Tom didn’t interrupt.

Karen opened the folder.

Inside were old tax statements, maintenance receipts, correspondence from previous HOA boards, and several photographs.

Some of the documents appeared to concern landscaping near her property.

None clearly established ownership of the entire paved strip.

Then Karen pulled out a yellowed photocopy.

“This is what I’ve been talking about.”

The board president, Helen Carter, examined it.

“Karen, this says you are responsible for maintenance adjacent to your lot.”

“Exactly.”

Helen looked at the paper again.

“It doesn’t say you own the parking area.”

Karen’s jaw tightened.

“It says I’m responsible for it.”

“That isn’t the same thing.”

Karen stood.

“So you’re all siding with them?”

“No,” Helen replied. “We’re trying to understand the documents.”

Karen’s eyes moved around the room.

Tom saw the same expression he’d seen when she had stood beside his car.

Certainty turning into anger because reality wasn’t cooperating.

Then Karen made a new claim.

“If everyone is allowed to park there, my property value is affected.”

That changed the discussion.

For the first time, her argument wasn’t about ownership alone.

It was about control.

The board agreed to request a current survey from a licensed professional.

Until then, everyone was asked to avoid blocking access and to leave the disputed strip unchanged.

Tom thought that would calm things down.

It didn’t.

That afternoon, he returned home and found a handwritten note under his windshield wiper.

MOVE YOUR CAR.

No signature.

Tom looked toward Karen’s house.

Her curtains were closed.

He didn’t move the car.

Instead, he photographed the note.

Then he noticed something else.

A small patch of fresh white paint had appeared on the pavement near his front tire.

Someone had started repainting the old boundary.

The surveyor was coming Friday.

But now somebody was changing the evidence before he arrived.
